When you are involved in a lawsuit, the sooner you file the suit the better chances that you will be paid the cash judgment against you. This article will detail how to file a Litigation Settlement Payment.
The first thing you need to do is find out the amount of money that you are owed when the case is settled, and what is your chances of getting paid it back in a timely fashion. The person who sue you must make sure that the amount of money they are claiming is accurate in every aspect, and that there is no dispute about this. If there is any disagreement about the amount of money, then you have to be prepared for a court hearing.
The court hearing is actually the easiest part. You will need to bring with you copies of your receipts or paychecks from your last six months' worth of jobs. Be honest and up front about everything you have done in the past few months. If you are unable to produce any evidence of the cash you are owed then you are required to give your case number so that the judge can verify everything. If you are not able to prove anything, you may be offered a trial with an arbitrator if this is the best option for you.
When you go to court, keep in mind that you are not being represented by a lawyer. You have all the right to question any evidence that you are given and you have the right to call witnesses. Your attorney should only be called to testify if it is necessary. Do not tell the court that you will hire an attorney before you speak to the arbitrator. Any attorney fees or court fees will have to be provided to you prior to the hearing. If this is not done then there is a good chance that the case will be dismissed without any award being made.
Once you have had the opportunity to appear at your hearing and to answer any questions that you may have asked your lawyer, it is time to go to court. Before going to court, however, make sure that you read the terms of the agreement so that you know what to expect. You should also be prepared for any type of testimony and documentation that might be required. You should bring copies of any bills or receipts from your work.
